The Will of

Edmund SAYERS (1656-1713)

In the name of God Amen I EDMUND SAYRES of PULBOROUGH in the County of Sussex yeoman being sick & weak in body but of sound judgment & of perfect mind & memory thankes be to Almighty God for the same calling to mind the certainty of my death & the uncertainty of the time when Doe here make & ordaine this my last Will & Testament in manner & forme following First I commend my soul into the hands of Almighty God trusting in & through the merits of Jesus Christ my only Saviour & Redeemer & my body to the Earth to be buried in Christian Buriall And as to my temporall Estate wherewith it hath pleased God to bless me with I doe here dispose thereof as followeth.   Item I give & bequeath to my son WILLIAM SAYRES the full sum of One Hundred pounds to be paid to him in lawfull money of Great Britain by my Executor when he shall come to          be of the full age of One & Twenty unless my Executors Trustees            up money out of my        & out of the Rents of my Executors Copyholds         son WILLIAM afore.   Item I give & bequeath to my son EDMUND SAYRES the full sum of Two Hundred pounds to be paid to him by my Executor in lawfull money of Great Britain when my Executor shall come to be of the age of One & Twenty And my will is that my Trustees shall give my son EDMUND his Dyet & Victualls meat & drink with my Executor untill my Trustees & my said Executor can pay him his Legacy or otherwise pay him Interest for his Legacie because I have left him the least of all my children in Lands so that he will have but little of present to support him   Item I give and bequeath to my son THOMAS SAYRES the full sum of Twenty pounds to be paid to him in lawfull money of Great Britain when my Executor comes to be of the age of One & Twenty years          whereas I have surrendered into the hands of the Lord of the Manor of Nutbourne my Two Copyholds called by the names of the Eastfields & Tanners to the use & behoof of my last Will & Testament as in & by the said Surrender in the Court tolls or Court book may more plaine appear I doe here will & devise that my said Two Copyholds called Eastfields & Tanners to be sold by my Trustees here my Cousin EDWARD SAYRES of WEST CHILTINGTON & my Cousin THOMAS SAYRES that liveth with me And the monies that shall arise & be made of the sale of my said Two Copyholds to be paid to my son EDMUND in part of the legacy afore given to him And if it shall happen that any one of my Trustees dye afore my Two Copyholds are sold that then my other Trustee should make sale & pay the money to my son EDMUND & if they both happen to dye afore the premises are sold then I will that the Executors or Administrators of my said Trustees doe make sale of the said Lands & pay the moneys to my son EDMUND And further my Will is that these Copyholds should not be sold till my Executor comes to be One & Twenty years for I would have my son JOHN Executor by it & pay his Three Brothers their Legacies for it lyes in the middle of his land & my Will is that my Executor doe pay his Brothers their Legacies here given them And I hope that what monies will be made of the stock & my debts paid & what will come out of the rents & the sale of the Copyholds will pay it or else my Meadowland called Earles Mead & Winterfold should have been bound to a hope paid it And I doe here will that THOMAS SAYRES use my Executors lands till he is of age I hope my Lord will stay for his Fine of Eastfields & Tanners till my Executor comes to be One & Twenty years of age And I doe here make my Son JOHN SAYRES sole Executor of this my last Will & Testament And I doe here make constitute & appoint my Cousin EDWARD SAYRES of WEST CHILTINGTON & my Cousin THOMAS SAYRES Trustees of this my last Will & Testament And to them I doe here committ the care & tuition of all my Children untill they comes to be of the age of One & Twenty years And I doe here authorize & inpower my said Trustees to take ask sue for recever & receive All monies due & owing to me at my decease & the same therewith to pay my Debts And further I will that my said Trustees my Cousin EDWARD SAYRES & his Brother my Cousin THOMAS SAYRES to look after all my childrens Lands for them untill they comes to be One & Twenty years of age And I will they lett my son WILLIAM use his land presently if he desire it & they to advise & assist him in useing of it and my son EDMUND I will that my Cousin THOMAS SAYRES use it for him or let it out for him till he comes to be One & Twenty years of age & to receive the rent for him And my son THOMAS SAYRES Copyhold I will that my Two Trustees look after it for him & to lett & putt the same & the rents thereof to take & receive for him till he comes to be One & Twenty years of age And I doe here will all my goods & chattells & personall Estate to be sold by my Friends JAMES ANDREW of THAKEHAM th’elder & my Cousin EDWARD SAYRES to be by them praised & sold to my Cousin THOMAS SAYRES so much of my stock as he shall think fitt to buy & if they Two cannot agree in the price thereof then to chuse a Third man & after my Cousin THOMAS SAYRES have bought what goods he pleases then for to make a sale & sell the rest But first of all if my friend JAMES ANDREW & EDWARD SAYRES think fitt to reserve my best goods & the best of my Linnen for my children & to be equally shifted amongst them And if my Executor happen to dye under age that my Copyhold herein called STYLE PLACE come to my son THOMAS that then I would have my son THOMAS SAYRES pay to his Two Brothers WILLIAM & EDMUND Fifty pounds apiece out of the mortgage I have upon Earlesmead & Winterfold And I desire my Trustees to pay the money I owe to my said Friends JAMES ANDREW & take in the Bond & the rest I owe beside upon bond & that my Two Kinsmen would be saving for my Children & to make up what monies they can to pay my debts & Legacies & be faithfull to the Trust I have here put the in & when my Children come to be of age to give up their Accounts In Witness whereof I EDMUND SAYRES the Elder have hereunto this my last Will & Testament sett my hand & seal this Seventeenth Day of January in the Twelfth year of the reigne of our
