The Will of
Churchman FIELD (1735-1815)

This is the last Will and Testament of me, Churchman Field of
Bletchingley in the County of Surry, yeoman. First I direct that all my just
debts funeral expences and the charges of proving this my will shall be paid
by my exor hereinafter named. I do hereby give and devise unto my nephew
James Field son of my late brother James Field
deceased one undivided moiety or equal half part the whole into two equal
parts to be divided of & in all that my messuage or tenement farm & lands
called Brocksmead containing by admeasurement one hundred and eight acres
one rood and twenty five perches little more or less situate lying and being
in the parish of Cuckfield in the County of Sussex & now in the joint
occupation of my said nephew James Field & of my nephew
Michael Field son of my brother John Field
or their assigns with the uppurts. And also one undivided moiety or equal
half part the whole into two equal parts to be divided of & in all those my
Great or Rectorial Tithes issuing out of my aforesaid farms and lands called
Brocksmead to hold the same several moieties of the said messuage farm &
lands & tithes unto and to the use of my said nephew James Field
& his assigns for & during the term of his natural life and from &
immediately after the decease of my said nephew James Field
then I do hereby give & devise all that the aforesaid undivided moiety of &
in my said messuage or tenement farm & lands called Brocksmead and all that
the aforesaid undivided moiety of & in my said tithes issuing thereout unto
& to the use of my great nephew James Field one of the sons
of my nephew James Field & his assigns for & during the
term of his natural life and from & immediately after the determination of
that estate by forfeiture or otherwise in the lifetime of him my said great
nephew James Field then I do hereby give & devise all that
the aforesaid undivided moiety of & in my aforesaid messuage farm & lands
called Brocksmead and all that the aforesaid undivided moiety of & in my
said tithes issuing thereout unto & to the use of my friends Joseph
Nash of Reigate in the said County of Surry yeoman &
William Stanley of Bletchingley aforesaid Gentleman and their heirs
during the natural life of my said great nephew James Field
in trust to support & preserve the contingent uses and estates hereinafter
limited from being defeated or destroyed and for that purpose to make
entries & bring actions as occasions shall be or require but nevertheless to
permit & suffer my said great nephew James Field & his
assigns to receive & take all the rents issues & profits thereof & of every
part thereof & for his & their own use & benefit for & during the term of
his natural life and from & immediately after the decease of my said great
nephew James Field then I do hereby give & devise all that
the aforesaid undivided moiety of & in my said messuage farm & lands called
Brocksmead and all the aforesaid undivided moiety of & in my said tithes
issuing thereout unto & to the use of the first son of the body of him my
said great nephew James Field lawfully to be begotten & of
the heirs male of the body of such first son lawfully issuing and for
default of such issue then I do hereby give & devise all that the aforesaid
undivided moiety of & in my said tithes issuing thereout unto & to the use
of the second third fourth fifth & all & every other the son & sons of the
body of him my said great nephew James Field lawfully to be
begotten severally successively & in remainder one after another as they &
every of them shall be in seniority of age & priority of birth & of the
several & respective heirs male of the body & bodies of all & every such son
& sons lawfully issuing the elder of such sons & the heirs male of his &
their body & bodies lawfully issuing to be always preferred & to take before
the younger of such son & sons & the heirs male of his & their body & bodies
lawfully issuing and for default of such issue then I do hereby give &
devise all that the aforesaid undivided moiety of & in my aforesaid messuage
farm & lands called Brocksmead and all that the aforesaid undivided moiety
of & in my said tithes issuing thereout unto & to the use of my great nephew
Churchman Field another of the sons of my said nephew
James Field & his assigns for & during the term of his

of my said great nephew Churchman Field in trust to support
& preserve contingent uses & estates herein after limited from being
defeated or destroyed and for that purpose to make entries & bring actions
as occasion shall be or require. But nevertheless to permit and suffer my
said great nephew Churchman Field & his assigns to receive
& take all the rents issues & profits thereof & of every part thereof to and
for his & their own use & benefit for & during the term of his natural life
and from & immediately after the decease of my said great nephew
Churchman Field then I do hereby give and devise all that the
aforesaid undivided moiety of & in my aforesaid messuage farm & lands called
Brocksmead and all that the aforesaid undivided moiety of & in my said
tithes issuing thereout unto & to the use of the first son of the body of
him my said great nephew Churchman Field lawfully to be
begotten & the heirs male of the body of such first son lawfully issuing and
for default of such issue then I do hereby give & devise all the aforesaid

otherwise in the life time of him my said great nephew William Field
then I do hereby give & devise all that the aforesaid undivided moiety of &
in my aforesaid messuage farm & lands called Brocksmead & all that the
aforesaid undivided moiety of & in my said tithes issuing thereout unto & to
the use of the said Joseph Nash & William Stanley
& their heirs during the natural life of my said great nephew
William Field in trust to support & preserve the contingent uses &
estates herein after limited from being defeated or destroyed & for that
purpose tomake entries & bring actions as occasion shall be or require. But
nevertheless to permit my said great nephew William Field &
his assigns to receive & take all the rents issues & profits thereof & of
every part thereof to & for his & their own use & benefit for & during the
term of his natural life and from & immediately after the decease of my said
great nephew William Field then I do hereby give & devise
all the aforesaid undivided moiety of & in my aforesaid messuage farm &
lands called Brocksmead & all that the aforesaid undivided moiety of & in my
said tithes issuing thereout unto & to the use of the first son of the body
of him my said great nephew William Field lawfully to be
begotten & of the heirs male of the body of such first son lawfully issuing
and for default of such issue then I do hereby give & devise all that the

of the sons of my said nephew James Field & his assigns for
& during the term of his natural life and from & immediately after the
determination of that estate by forfeiture or otherwise in the life time of
him my said great nephew Thomas Field then I do hereby give
& devise all that the aforesaid undivided moiety of & in my aforesaid
messuage farm & lands called Brocksmead and all that the aforesaid undivided
moiety of & in the said tithes issuing thereout unto & to the use of the
said Joseph Nash & William Stanley & their
heirs during the natural life of my said great nephew Thomas Field
in trust to support & preserve the contingent uses and estates herein after
limited from being defeated or destroyed and for that purpose to make
entries & bring actions as occasion shall be or require but nevertheless to
permit & suffer my said great nephew Thomas Field & his
assigns to receive & take all the rents issues & profits thereof & of every
part thereof to &
for his own use & benefit for & during the term of his natural life and from

Thomas Field lawfully to be begotten & of the heirs male of the
body of such first son lawfully issuing and for default of such issue then I
do hereby give & devise all that the aforesaid undivided moiety of & in my
aforesaid messuage farm & lands called Brocksmead & all that the aforesaid
undivided moiety of & in my said tithes issuing thereout unto & to the use

Henry Field then I do hereby give & devise all that the
aforesaid undivided moiety of & in my aforesaid messuage farm & lands called
Brocksmead and all that the aforesaid undivided moiety of & in the said
tithes issuing thereout unto & to the use of the said Joseph Nash
& William Stanley & their heirs during the natural life of
my said great nephew Henry Field in trust to support &
preserve the contingent uses and estates herein after limited from being
defeated or destroyed and for that purpose to make entries & bring actions
as occasion shall be or require but nevertheless to permit & suffer my said
great nephew Henry Field & his assigns to receive & take
all the rents issues & profits thereof & of every part thereof to & for his
own use & benefit for & during the term of his natural life and from &
immediately after the decease of my said great nephew Henry Field
then I do hereby give and devise all that the aforesaid undivided moiety of
& in my aforesaid messuage farm & lands called Brocksmead and all that the
aforesaid undivided moiety of & in the said tithes issuing thereout unto &
to the use of the first son of the body of him my said great nephew
Henry Field lawfully to be begotten & of the heirs male of the body
of such first son lawfully issuing and for default of such issue then I do
hereby give & devise all that the aforesaid undivided moiety of & in my
aforesaid messuage farm & lands called Brocksmead & all that the aforesaid
undivided moiety of & in my said tithes issuing thereout unto & to the use
of the second third fourth fifth & all & every other the son & sons of the
body of him my said great nephew Henry Field lawfully to be
begotten severally successively and in remainder one after another as they &
every of them shall be in seniority of age and priority of birth & of the
several & respective heirs male of the body & bodies of all & every such son
& sons lawfully issuing the elder of such sons and the heirs male of his &
their body & bodies lawfully issuing to be always preferred & to take before
the younger of such son & sons & the heirs male of his & their body & bodies
lawfully issuing and for default of such issue then I do hereby give &
devise all that the aforesaid undivided moiety of & in my aforesaid messuage
farm & lands called Brocksmead & all that the aforesaid undivided moiety of
& in my said tithes issuing thereout unto such person or persons as shall
then be the heir at law of my said late brother James Field
to hold the same unto & to the use of such person or persons as last
aforesaid & of his her or their heirs & assigns for ever. Also I do hereby
give & devise unto my said brother John Field & his assigns
for & during the term of his natural life one annuity or clear yearly rent
charge of thirty pounds of lawful money of the United Kingdom of Great
Britain & Ireland current in Great Britain to be issuing and payable out of
and charged and chargeable upon all that my messuage or tenement farm &
lands called Thorndean otherwise Little Thorndean containing by
admeasurement forty two acres & thirty two perches little more or less
situate lying & being in the parish of Cuckfield aforesaid and now in the
occupation of my said nephews James Field and
Michael Field or their assigns with the appurts and also out of &
upon all those my great or Rectorial tithes issuing out of my said last
mentioned farm & lands & also out of & upon the other & remaining undivided
moiety or equal half part (the whole into two equal parts to be divided) of
& in my aforesaid messuage farm & lands called Brocksmead & the appurts
thereunto belonging & also out of & upon the other & remaining undivided
moiety or equal half part the whole into two equal parts to be divided of &
in my said great or Rectorial tithes issuing out of my said last mentioned
farm & lands. And I do hereby direct that the said annuity or yearly rent
charge of thirty pounds so by me given & devised unto my said brother
John Field or his assigns as aforesaid shall be free &
clear of & from all taxes & deductions whatsoever & shall be so paid unto
him my said brother John Field or his assigns on the four
most usual feast days or days of payment of rent in the year that is to say
the feast of the Annunciation of the Blessed Virgin Mary the Nativity of St.
John the Baptist Saint Michael the Archangel & the birth of our Lord Christ
in every year by even and equal portions the first payment thereof to begin
& be made on such of the said feast days as shall first & next happen after
my decease and it is my will and meaning and I do hereby direct that it
shall & may be lawful to & for my said brother John Field &
his assigns from time to time & at all times after any default in payment of
the said annuity or yearly rent charge of thirty pounds so by me given &
devised unto him my said brother John Field as aforesaid by
the space of twenty one days next over or after any of the said feast days
whereon the said is appointed to be paid as aforesaid to enter & come into &
upon the said messuage farm lands & heredits so charged with the payment of
the same annuity or yearly rent charge as aforesaid or into & upon any part
of the said heredits so charged therewith as aforesaid there to distrain for
the said annuity or yearly rent charge & to take away or impound & keep upon
the said premises the distress & distresses there made to sell the same
within the space of five days for payment of all arrears of the said annuity
or yearly rent charge and all costs & charges attending such distress or
distresses & sale or sales. And from & immediately after the decease of my
brother John Field then I do hereby give & devise unto
Sarah Field the wife of my said brother John Field
& her assigns for & during the term of her natural life in case she shall
happen to survive her said husband one annuity or clear yearly rent charge
of seven pounds of lawful money of the United Kingdom of Great Britain &
Ireland current in Great Britain to be issuing & payable out of & chargeable
upon all that my aforesaid messuage farm & lands called Thorndean otherwise
Little Thorndean with the appurts. And I do hereby direct that the said
annuity or yearly rent charge of seven pounds so by me given and devised
unto the said Sarah Field & her assigns as aforesaid shall
be free & clear of & from all taxes & deductions whatsoever & shall be so
paid unto her or them on the several herein before mentioned feast days of
the Annunciation of the blessed Virgin Mary the Nativity of Saint John the
Baptist Saint Michael the Archangel & the birth of our Lord Christ in every
year by even & equal portions the first payment thereof to begin & be made
on such of the said feast days as shall first & next happen after the
decease of my said brother John Field. And it is my will &
meaning & I do hereby direct that the said Sarah Field &
her assigns shall in default of payment of the said annuity or yearly rent
charge of seven pounds herein before by me given & devised unto her as
aforesaid have such & the like powers of entry & distress & sale into and
upon my said messuage farm & lands called Thorndean otherwise Little
Thorndean so charged with the payment of the said annuity as aforesaid as
are herein before by me mentioned and expressed in respect of the said
annuity or yearly rent charge of thirty pounds herein before by me given &
devised unto my said brother John Field as aforesaid and so
respectively charged with the payment of the said annuity or yearly rent
charge of thirty pounds unto my said brother John Field or
his assigns during his life as aforesaid & with the payment of the said
annuity or yearly rent charge of seven pounds unto the said Sarah
Field & her assigns from & after the decease of her said husband in
case she shall happen to survive him as aforesaid I do hereby give & devise
unto my said nephew Michael Field (son of my brother
John Field) all that my aforesaid messuage farm & lands
called Thorndean otherwise Little Thorndean with the appurts & all my said
great or Rectorial tithes issuing out of the same farm & lands and also the
said herein before last mentioned undivided moiety of & in my aforesaid
messuage farm & lands called Brocksmead & the said great or Rectorial tithes
issuing out of my said last mentioned farm & lands to hold my said messuage
farm & lands called Thorndean otherwise Little Thorndean & my said tithes
issuing thereout & the said herein before last mentioned undivided moiety of
& in my said messuage farm & lands called Brocksmead & the said herein
before last mentioned undivided moiety of & in my said tithes issuing out of
my said last mentioned farm & lands unto & to the use of my said nephew
Michael Field & his assigns for & during the term of his
natural life. But nevertheless charged & chargeable as aforesaid from &
immediately after the decease of my said nephew Michael Field
then I do hereby give & devise all that my aforesaid messuage farm & lands
called Thorndean otherwise Little Thorndean and my said tithes issuing
thereout & the said last herein before mentioned undivided moiety of & in my
said messuage farm & lands called Brocksmead & the said herein before
mentioned undivided moiety of & in my said tithes issuing thereout of my
said last mentioned farm & lands but nevertheless charged & chargeable as
aforesaid unto & to the son of my great nephew Michael Field
one of the sons of my said nephew Michael Field & his
assigns for & during the term of his natural life and from & immediately
after the determination of that estate by forfeiture or otherwise in the
life time of him my said great nephew Michael Field then I
do hereby give & devise all that my aforesaid messuage farm & lands called
Thorndean otherwise Little Thorndean and my said tithes issuing thereout &
the said herein before mentioned undivided moiety of & in my aforesaid
messuage farm & lands called Brocksmead and the said herein before last
mentioned undivided moiety of & in my said tithes issuing thereout of my
said last mentioned messuage farm & lands unto & to the use of the said
Joseph Nash & William Stanley & their
heirs during the natural life of my said great nephew Michael Field
in trust to support & preserve the contingent uses & estates herein after
limited from being defeated or destroyed & for that purpose to make entries

Brocksmead & the said herein before last mentioned undivided moiety of my
said tithes issuing thereout of my said last mentioned farm & lands but
nevertheless charged & chargeable as aforesaid unto & to the son of the
first son of the body of him my said great nephew Michael Field

lawfully issuing and for default of such issue then I do hereby give &

the other son of my said nephew Michael Field & his assigns

such issue then I do hereby give & devise all that my aforesaid messuage
farm & lands called Thorndean otherwise Little Thorndean & my said tithes
issuing thereout and the said herein before last mentioned undivided moiety
of & in my said messuage farm & lands called Brocksmead & the said herein
before last mentioned undivided moiety of & in my said tithes issuing out of
my said last mentioned farm & lands but nevertheless charged & chargeable as
aforesaid unto & to the son of the second third fourth fifth & all & every
other the son & sons of the body of him my said great nephew John
Field lawfully to be begotten severally successively & in remainder
one after another as they & every of them shall be in seniority of age &
priority of birth & of the several & respective heirs male of the body &
bodies of all & every such son & sons lawfully issuing the elder of such
sons & the heirs male of his & their body & bodies lawfully issuing to be
always preferred to take before the younger of such son & sons & the heirs
male of his & their body & bodies lawfully issuing and for default of such
issue then I do hereby give and devise all that my aforesaid messuage farm &
lands called Thorndean otherwise Little Thorndean & my said tithes issuing
thereout and the said herein before last mentioned undivided moiety of & in
my said messuage farm & lands called Brocksmead & the said herein before
last mentioned undivided moiety of & in my said tithes issuing out of my
said last mentioned farm & lands unto my brother John Field
to hold the same unto & to the only use of him my said brother John
Field & of his heirs & assigns for ever. Also I do hereby give &
devise unto my said brother John Field & his assigns for &
during the term of his natural life one annuity or clear yearly rent charge
of five pounds of lawful money of the United Kingdom of Great Britain &
Ireland current in Great Britain to be issuing and payable out of and
charged and chargeable upon all the my messuage or tenement farm & lands
called Great Merrifields containing by admeasurement thirteen acres three
roods & thirty two perches little more or less with the appurts and also out
of & upon all those my messuage or tenement farm & lands called Little
Merrifields containing by estimation nine acres one rood and twenty four
perches little more or less with their respective appurts all which said
several messuages or tenements farms & lands called Great Merrifields &
Little Merrifields are situate lying & being in the parish of Cuckfield
aforesaid & are now in the occupation of my said nephews James Field
& Michael Field and I do hereby direct that the said
annuity or yearly rent charge of five pounds so by me given & devised unto
my brother John Field & his assigns as aforesaid shall be
free & clear of & from all taxes & deductions whatsoever & shall be so paid
unto him my said brother John Field or his assigns on the
four most usual feast days or days of payment of rent in the year that is to
say the feast of the Annunciation of the Blessed Virgin Mary the Nativity of
St John the Baptist Saint Michael the Archangel & the birth of our Lord
Christ in every year by even and Equal portions the first payment thereof to
begin & be made on such of the said feast days as shall first & next happen
after my decease and it is my will and meaning and I do hereby direct that
it shall & may be lawful to & for my said brother John Field
& his assigns shall in default in payment of the said annuity or yearly rent
charge of five pounds herein before by me given & devised unto him have such
& the like powers of entry distress & sale into & upon the said messuages
farms lands & heredits so charged with the payment of the same annuity as
aforesaid as are herein before by me mentioned & expressed in respect of the
said annuity or yearly rent charge of thirty pounds herein before by me
given & devised unto my said brother John Field as
aforesaid. And from and immediately after the decease of my said brother
John Field then I do hereby give & devise unto
Sarah Field the wife of my said brother John Field
& her assigns for & during the term of her natural life in case she shall
happen to survive her said husband one annuity or clear yearly rent charge
of seven pounds of lawful money of the United Kingdom of Great Britain &
Ireland current in Great Britain to be issuing & payable out of & chargeable
upon all those my aforesaid several messuages or tenements farms & lands
called Great Merrifields & Little Merrifields with their respective appurts.
And I do hereby direct that the said annuity or yearly rent charge of seven
pounds so by me lastly given and devised unto the said Sarah Field
& her assigns as aforesaid shall be free & clear of & from all taxes &
deductions whatsoever & shall be so paid unto her or them on the several
herein before mentioned feast days of the Annunciation of the blesses Virgin
Mary the Nativity of Saint John the Baptist Saint Michael the Archangel &
the birth of our Lord Christ in every year by even & equal portions the
first payment thereof to begin & be made on such of the said feast days as
shall first & next happen after the decease of my said brother John
Field. And it is my will & meaning & I do hereby direct that the
said Sarah Field & her assigns shall in default of payment of the said last
mentioned annuity or yearly rent charge of seven pounds herein before by me
lastly given & devised unto her as aforesaid have such & the like powers of

farms & lands called Great Merrifields & Little Merrifields so charged with

John Field as aforesaid and so respectively charged with
the payment of the said annuity or yearly rent charge of five pounds unto my
said brother John Field or his assigns during his life as
aforesaid & with the payment of the said annuity or yearly rent charge of
seven pounds herein before by me lastly given & devised unto the said
Sarah Field & her assigns from & after the decease of her
saidhusband in case she shall happen to survive him as aforesaid I do hereby
give & devise unto my said nephew John Field another of the
sons of my said brother John Field all those my aforesaid
several messuages or tenements farms & lands called Great Merrifields &
Little Merrifields with their respective appurts and also all those my great
or Rectorial tithes issuing out of the said several farms & lands to hold
the same several messuages or tenements farms lands & tithes unto & to the
use of my said nephew John Field & his assigns for & during
the term of his natural life but nevertheless charged & chargeable as
aforesaid and from & immediately after the decease of my said nephew
John Field then I do hereby give & devise all those my aforesaid
several messuages or tenements farms & lands called Great Merrifields &
Little Merrifields with their respective appurts and all those my aforesaid
great or Rectorial tithes issuing out of the same several farms & lands but
nevertheless charged & chargeable as aforesaid unto & to the use of my great
nephew John Field (the son of my said nephew John
Field) for & during the term of his natural life and from &
immediately after the determination of that estate by forfeiture or
otherwise in the life time of him my said last named great nephew
John Field then I do hereby give & devise all those my aforesaid
several messuages farms & lands called Great Merrifields & Little
Merrifields with their respective appurts and all those my aforesaid great
or Rectorial tithes issuing out of the said several farms & lands unto & to
the use of the said Joseph Nash & William Stanley
& their heirs during the natural life of my said last named great nephew
John Field in trust to support & preserve the contingent
uses & estates hereinafter limited from being defeated or destroyed & for
that purpose to make entries & bring actions as occasion shall be or require
but nevertheless to permit & suffer my said great nephew John Field
& his assigns to receive & take all the rents issues & profits thereof & of
every part thereof to & for his & their own use & profit for & during the
term of his natural life and from & immediately after the decease of my said
great nephew John Field then I do hereby give & devise all
those my aforesaid several messuages or tenements farms & lands called Great
Merrifields & Little Merrifields with their respective appurts and all those
my aforesaid great or Rectorial tithes issuing out of the same several farms
& lands but nevertheless charged & chargeable as aforesaid unto & to the use
of the first son of the body of him my said great nephew John Field
lawfully to be begotten & of the heirs male of the body of such first son
lawfully issuing and for default of such issue then I do hereby give &
devise all those my aforesaid several messuages or tenements farms & lands
called Great Merrifields & Little Merrifields with their respective appurts
and all those my aforesaid great or Rectorial tithes issuing out of the same
several farms & lands that my aforesaid but nevertheless charged &
chargeable as aforesaid unto & to the use of thesecond third fourth fifth &
all & every other the son & sons of the body of him my said great nephew
John Field lawfully to be begotten severally successively &
in remainder one after another as they & every of them shall be in seniority
of age & priority of birth & of the several & respective heirs male of the
body & bodies of all & every such son & sons lawfully issuing the elder of
such sons & the heirs male of his & their body & bodies lawfully issuing to
be always preferred to take before the younger of such son & sons & the
heirs male of his & their body & bodies lawfully issuing and for default of
such issue then I do hereby give devise unto my said nephew Michael
Field (son of my said brother John Field) all
those my aforesaid several messuages or tenements farms & lands called Great
Merrifields & Little Merrifields with their respective appurts and all those
my aforesaid great or Rectorial tithes issuing out of the same several farms
& lands to hold the same several messuages lands & tithes unto & to the use
of him my said nephew Michael Field & his assigns for &
during the term of his natural life but nevertheless charged & chargeable as
aforesaid. And from & immediately after the decease of my said nephew
Michael Field then I do hereby give & devise all those my aforesaid several
messuages or tenements farms & lands but nevertheless charged & chargeable
as aforesaid unto & to the use of my said great nephew Michael Field
(son of my said nephew Michael Field) & his assigns for &
during the term of his natural life and from & immediately after the
determination of that estate by forfeiture or otherwise in the life time of
him my said great nephew Michael Field then I do hereby
give & devise all those my aforesaid several messuages or tenements farms &
lands called Great Merrifields & Little Merrifields with their respective
appurts and all those my aforesaid great & Rectorial tithes issuing out of
the same several farms and lands Joseph Nash &
William Stanley & their heirs during the natural life of my said
great nephew Michael Field in trust to support & preserve
the contingent uses & estates herein after limited from being defeated or
destroyed & for that purpose to make entries & bring actions as occasion
shall be or require but nevertheless to permit & suffer my said great nephew
Michael Field & his assigns to receive & take all the rents
issues & profits thereof & of every part thereof & for his & their own use &
profit for & during the term of his natural life and from & immediately
after the decease of my said great nephew Michael Field
then I do hereby give & devise all those my aforesaid several messuages or
tenements farms & lands called Great Merrifields & Little Merrifields with
their respective appurts and all those my aforesaid great & Rectorial tithes
issuing out of the same several farms and lands but nevertheless charged &
chargeable as aforesaid unto & to the use of the first son of the body of
him my said great nephew Michael Field lawfully to be
begotten & of the heirs male of the body of such first son lawfully issuing
and for default of such issue then I do hereby give & devise all those my
aforesaid several messuages or tenements farms & lands called Great
Merrifields & Little Merrifields with their respective appurts and all those
my aforesaid great & Rectorial tithes issuing out of the same several farms
and lands that my aforesaid but nevertheless charged & chargeable as

John Field (son of my said nephew Michael Field)

immediately after the decease of my said last named great nephew
John Field then I do hereby give & devise all those my aforesaid
several messuages or tenements farms & lands called Great Merrifields &
Little Merrifields with their respective appurts and all those my aforesaid
great & Rectorial tithes issuing out of the same several farms and lands but
nevertheless charged & chargeable as aforesaid unto & to the use of the
first son of the body of him my said great nephew John Field
lawfully to be begotten & of the heirs male of the body of such first son
lawfully issuing and for default of such issue then I do hereby give &
devise all those my aforesaid several messuages or tenements farms & lands
called Great Merrifields & Little Merrifields with their respective appurts
and all those my aforesaid great & Rectorial tithes issuing out of the same
several farms and lands that my aforesaid but nevertheless charged &
chargeable as aforesaid unto & to the use of the second third fourth fifth &

Rectorial tithes issuing out of the same several farms and lands but
nevertheless charged & chargeable as aforesaid unto my said brother
John Field & his heirs to hold the same unto & to the only use of
my said brother John Field & of his heirs & assigns for
ever. Also I do hereby give & devise unto my said brother John Field
& his assigns for & during the term of his natural life one annuity or clear
yearly rent charge of five pounds of lawful money of Great Britain to be
issuing and payable out of & charged & chargeable upon all that my messuage
farm & lands called Crouchers containing by estimation twenty acres more or
less situate lying & being in the parish of Bolney in the County of Sussex
with the appurts and also out of and upon all that my part or parcel of
woodland called the Inhomes situate lying & being in the parish of Bolney &
used with my said messuage farm & lands called Crouchers with the appurts
which said messuage farm & lands called Crouchers & part or parcel of
woodland called the Inholms are now in the occupation of my nephew
James Field son of my said brother John Field. And
I do hereby direct that the said last mentioned annuity or yearly rent
charge of five pounds so by me given & devised unto my said brother
John Field as aforesaid shall be free & clear of & from all taxes &

said annuity or yearly rent charge of thirty pounds herein before by me
given & devised unto my said brother John Field as
aforesaid & respectively charged with the payment of one moiety or equal
half part of the said annuity or yearly rent charge of five pounds herein
before by me lastly given & devised unto my said brother John Field
& assigns during his life as aforesaid & with the payment of one moiety or
equal half part of the said annuity or yearly rent charge of seven pounds
herein before by me lastly given & devised unto the said Sarah Field
& her assigns from & after the decease of her said husband in case she shall
happen to survive him as aforesaid I do hereby give & devise one undivided
moiety or equal half part (the whole into two equal parts to be divided) of
& in all that my said messuage farm & lands called Crouchers with the
appurts and of & in all that my aforesaid part or parcel of woodland called
the Inholms with the appurts unto & to the use of my said nephew
James Field (one of the sons of my said brother John Field)
& his assigns for & during the term of his natural life and from & after the
determination of that estate by forfeiture or otherwise in the life time of
him my said last named nephew James Field then I do hereby
give & devise all that the aforesaid undivided moiety of & in my aforesaid
messuage farm & lands called Crouchers and of & in my aforesaid part or
parcel of woodland called the Inholms unto & to the use of the said
Joseph Nash & William Stanley & their hairs during
the natural life of my said last named nephew James Field
in trust to support & preserve the contingent uses & estates herein after
limited from being defeated or destroyed & for that purpose to make entries
& bring actions as occasion shall be or require but nevertheless to permit &
suffer my said nephew James Field & his assigns to receive
& take all the rents issues & profits thereof & of every part thereof & for
his & their own use & benefit for & during the term of his natural life and
from & immediately after the decease of my said last named nephew
James Field then I do hereby give & devise all that the aforesaid
undivided moiety of & in my aforesaid messuage farm & lands called Crouchers
and of & in my aforesaid part or parcel of woodland called the Inholms but
nevertheless charged & chargeable as aforesaid unto & to the use of the
first son of the body of him my said last named nephew James Field
lawfully to be begotten & of the heirs male of the body of such first son
lawfully issuing and for default of such issue then I do hereby give &
devise all that my aforesaid undivided moiety of & in my aforesaid messuage
farm & lands called Crouchers and of & in my aforesaid part or parcel of
woodland called the Inholms but nevertheless charged & chargeable as

another of the sons of my said brother John Field & his
assigns for & during the term of his natural life and from & after the
determination of that estate by forfeiture or otherwise in the life time of
him my said nephew William Field then I do hereby give &
devise all that the aforesaid undivided moiety of & in my aforesaid messuage
farm & lands called Crouchers and of & in my aforesaid part or parcel of
woodland called the Inholms unto & to the use of the said Joseph
Nash & William Stanley & their heirs during the
natural life of my said nephew William Field in trust to
support & preserve the contingent uses & estates herein after limited from
being defeated or destroyed & for that purpose to make entries & bring
actions as occasion shall be or require but nevertheless to permit & suffer
my said nephew William Field & his assigns to receive &
take all the rents issues & profits thereof & of every part thereof & for
his & their own use & benefit for & during the term of his natural life. And

then I do hereby give & devise all that the aforesaid undivided moiety of &
in my aforesaid messuage farm & land called Crouchers and of & in my
aforesaid part or parcel of woodland called the Inholms but nevertheless
charged & chargeable as aforesaid unto & to the use of the first son of the
body of him my said last named nephew William Field
lawfully to be begotten & of the heirs male of the body of such first son
lawfully issuing and for default of such issue then I do
hereby give & devise all that my aforesaid undivided moiety of & in my
aforesaid messuage farm & land called Crouchers and of & in my aforesaid
part or parcel of woodland called the Inholms but nevertheless charged &

the use of him my said brother John Field & of his heirs &
assigns for ever and respectively charged & chargeable with the payment of
the other moiety or equal half part of the said annuity or yearly rent
charge of five pounds herein before by me lastly given & devised unto my
said brother John Field as aforesaid & with the payment of
the other moiety or equal half part of the said annuity or yearly rent
charge of seven pounds herein before by me lastly given & devised unto the
said Sarah Field & her assigns from & after the decease of
her said husband in case she shall happen to survive him as aforesaid I do
hereby give & devise the other & remaining undivided moiety or equal half
part (the whole into two equal parts to be divided of & in all that my
aforesaid messuage farm & land called Crouchers and of & in my aforesaid
part or parcel of woodland called the Inholms with the appurts unto & to the
use of my said nephew William Field son of my said brother
John Field & his assigns for & during the term of his
natural life and from & after the determination of that estate by forfeiture
or otherwise in the life time of him my said nephew William Field
then I do hereby give & devise all that the aforesaid last mentioned
undivided moiety of & in my aforesaid messuage farm & land called Crouchers
and of & in my aforesaid part or parcel of woodland called the Inholms unto
& to the use of the said Joseph Nash & William
Stanley & their heirs during the natural life of my said nephew
William Field in trust to support & preserve the contingent
uses & estates herein after limited from being defeated or destroyed & for
that purpose to make entries & bring actions as occasion shall be or require
but nevertheless to permit & suffer my said nephew William Field
& his assigns to receive & take all the rents issues & profits thereof & of
every part thereof & for his & their own use & benefit for & during the term
of his natural life. And from & immediately after the decease of my said
nephew William Field then I do hereby give & devise all
that the aforesaid last mentioned undivided moiety of & in my aforesaid
messuage farm & land called Crouchers and of & in my aforesaid part or
parcel of woodland called the Inholms but nevertheless charged & chargeable
as aforesaid unto & to the use of the first son of the body of him my said
nephew William Field lawfully to be begotten & of the hairs
male of the body of such first son lawfully issuing and for default of such
issue then I do hereby give & devise all that my aforesaid undivided moiety
of & in my aforesaid messuage farm & land called Crouchers and of & in my
aforesaid part or parcel of woodland called the Inholms but nevertheless
charged & chargeable as aforesaid unto & to the use of the second third

nephew William Field lawfully to be begotten severally

Crouchers and of & in my aforesaid part or parcel of woodland called the
Inholms but nevertheless charged & chargeable as aforesaid unto & to the use
of my said nephew James Field (son of my said brother
John Field) & his assigns for & during the term of his
natural life and from & immediately after the determination of that estate
by forfeiture or otherwise in the life time of my said last named nephew
James Field then I do hereby give & devise all that the
aforesaid last mentioned undivided moiety of & in my aforesaid messuage farm
& land called Crouchers and of & in my aforesaid part or parcel of woodland
called the Inholms unto & to the use of the said Joseph Nash
& William Stanley & their heirs during the natural life of
my said nephew James Field in trust to support & preserve
the contingent uses & estates herein after limited from being defeated or
destroyed & for that purpose to make entries & bring actions as occasion
shall be or require but nevertheless to permit & suffer my said last named
nephew James Field & his assigns to receive & take all the
rents issues & profits thereof & of every part thereof & for his & their own
use & benefit for & during the term of his natural life. And from &
immediately after the decease of my said nephew James Field then I do hereby
give & devise all that the aforesaid last mentioned undivided moiety of & in
my aforesaid messuage farm & land called Crouchers and of & in my aforesaid
part or parcel of woodland called the Inholms but nevertheless charged &
chargeable as aforesaid unto & to the use of the first son of the body of
him my said nephew James Field lawfully to be begotten & of
the heirs male of the body of such first son lawfully issuing and for
default of such issue then I do hereby give & devise all that my aforesaid
undivided moiety of & in my aforesaid messuage farm & land called Crouchers
and of & in my aforesaid part or parcel of woodland called the Inholms but
nevertheless charged & chargeable as aforesaid unto & to the use of the
second third fourth fifth & all & every other the son & sons of the body of
him my said nephew James Field lawfully to be begotten
severally successively & in remainder one after another as they & every of
them shall be in seniority of age & priority of birth & of the several &
respective heirs male of the body & bodies of all & every such son & sons
lawfully issuing the elder of such sons & the heirs male of his & their body
& bodies lawfully issuing to be always preferred to take before the younger
of such son & sons & the heirs male of his & their body & bodies lawfully
issuing and for default of such issue then I do hereby give & devise all
that the aforesaid undivided moiety of & in my aforesaid messuage farm &
lands called Crouchers & of & in my aforesaid part & parcel of woodland
called the Inholms unto & to the only use of him my said brother
John Field & of his heirs & assigns for ever. Also I give &
bequeath unto my said brother John Field the sum of fifty
pounds of lawful money to be paid unto him within twelve calendar months
next after my decease by my executors herein after named. Also I give &
bequeath unto my nephew & nieces Michael Field, Ann
Bryant the wife of John Bryant, Mary Lewry
widow & Elizabeth Smith the wife of Edward Smith
(son & daughters of my said late brother James Field) the
sum of two hundred pounds apiece of lawful money to be paid unto them
respectively within twelve calendar months next after my decease by my exors
herein after named. Also I give & bequeath unto my nephews & niece
Joseph Field, Churchman Field & Elizabeth Field
(sons and daughter of my said brother John Field) the sum
of two hundred pounds apiece of lawful money to be paid unto them
respectively within twelve calendar months next after my decease or on their
severally attaining their respective ages of twenty one years which shall
last happen by my exors herein after named. Also I give & bequeath unto my
nephews & nieces Joseph Potter, William Potter,
Ann Hubble widow now dwelling with me & Mary Coles
the wife of William Coles (sons & daughters of my late
sister Elizabeth Potter deceased) three hundred pounds Sterling apiece in
the three pounds per centum consolidated annuities transferrable at the Bank
of England the same to be transferred unto them respectively within twelve
calendar months next after my decease by my exors herein after named. Also I
give and bequeath unto my nieces Lydia Morey now the wife
of BLANK Morey & Mary Lewis widow
daughters of my late sister Sarah Hamper deceased three
hundred pounds Sterling apiece in the said three pounds per centum
consolidated annuities transferrable at the Bank of England the same to be
transferred unto them my said nieces Lydia Morey &
Mary Lewis respectively within twelve calendar months next after my
decease by my exors herein after named. Also I give & bequeath unto my
nephew & nieces John Weaire & Mary Weaire
& Catherine the wife of William Crook (the
son & daughters of my late sister Mary Weaire deceased) the
sum of two hundred pounds apiece of lawful money to be paid unto them
respectively within twelve calendar months next after my decease by my exors
herein after named. Also I give & bequeath unto my nephew John
Steadman (son of my late sister Catherine Steadman
deceased) three hundred pounds Sterling apiece in the said three pounds per
centum consolidated annuities transferrable at the Bank of England the same
to be transferred unto him within twelve calendar months next after my
decease by my exors herein after named. Also I give & bequeath unto all the
children of my late nephew John Potter deceased (another
son of my said late sister Elizabeth Potter) three hundred
pounds Sterling apiece in the said three pounds per centum consolidated
annuities transferrable at the Bank of England the same to be equally
divided amongst them share & share alike & their respective shares to be
transferred unto them on their severally attaining their respective ages of
twenty one years by my exors herein after named. Also I give and bequeath
unto all the children of my late nephew John Hamper
deceased (son of my said late sister Sarah Hamper) three
hundred pounds Sterling apiece in the said three pounds per centum
consolidated annuities transferrable at the Bank of England the same to be
equally divided amongst them share & share alike & their respective shares
to be transferred unto them on their severally attaining their respective
ages of twenty one years by my exors herein after named. Also I give &
bequeath unto all the children of my late niece Martha Myrth
deceased (the late wife of William Myrth & daughter of my
said late sister Sarah Hamper) three hundred pounds
Sterling apiece in the said three pounds per centum consolidated annuities
transferrable at the Bank of England the same to be equally divided amongst
them share & share alike & their respective shares to be transferred unto
them on their severally attaining their respective ages of twenty one years
by my exors herein after named. Also I give & bequeath unto my great nephew
James Sanderson son of my late niece Elizabeth
Sanderson deceased the late wife of James Sanderson
& the other daughter of my said late sister Mary Weaire the
sum of three hundred pounds of lawful money to be paid unto him on his
attaining his age of twenty one years by my exors herein after named. Also I
give & bequeath unto my great niece Mary Bannister (the
daughter of my late niece Mary Bannister deceased the late
wife of Thomas Bannister deceased) & one of the daughters
of my said late sister Catherine Steadman three hundred
pounds Sterling apiece in the said three pounds per centum consolidated
annuities transferrable at the Bank of England the same to be transferred
unto her my said great niece Mary Bannister on her
attaining the age of twenty one years by my exors hereinafter named. Also I
give & bequeath unto all the children of my late
niece Catherine Bilcliffe deceased the late wife of
Thomas Bilcliffe deceased & who was the other daughter of my said
late sister Catherine Steadman three hundred pounds
Sterling apiece in the said three pounds per centum consolidated annuities
transferrable at the Bank of England the same to be equally divided amongst
them share & share alike & their respective shares to be transferred unto
them on their severally attaining their respective ages of twenty one years
by my exors herein after named. Also I give & bequeath unto my said niece
Ann Hubble all my household goods & furniture of households
which shall at the time of my decease be in the messuage in Bletchingly
aforesaid which I now hold of William Henrick Esqr & which
was lately in the occupation of Sarah Roffey & is now in
the occupation of George Alexander as my under tenant. And
also all my household goods and furniture of household which shall at the
time of my decease be in the parlour of my leasehold messuage in Bletchingly
aforesaid in which I now dwell & in the chamber over the same parlour and
also my bed which is in the same chamber & all the furniture to the same bed
belonging and also all my plate linen & china whatsoever. And all the rest &
residue of my household goods & furniture of household which shall at the
time of my decease be in the said messuage in which I now dwell I do hereby
give & bequeath unto my said nephew John Weaire. Also I
give & bequeath unto my said niece Ann Stubble (?
Hubble? DW) the exclusive use & liberty of dwelling in her own
proper person only the aforesaid parlour in the said leasehold messuage in
which I now dwell & the said chamber over the same parlour for & during all
the remainder of the term for which I shall at the time of my decease hold
the said messuage without paying any rent or making any satisfaction for the
same and subject to the said use of & liberty of dwelling in the said
parlour & chamber herein before by me given & bequeathed unto my said niece
Ann Hubble as aforesaid I do hereby give & bequeath unto my
said nephew John Weaire all & every my leasehold messuages
farms & lands with their respective appurts and all my farms & lands which I
hold under & by virtue of any agreements or contracts for leases thereof
with their appurts and all my estate terms & interest therein respectively
to hold the same subject as aforesaid unto him my said nephew John
Weaire his exors admors and assigns for & during all the remainder
of the respective terms for which I shall at the time of my decease hold the
same and it is my will & meaning and I do hereby direct that if my said
nephew John Weaire shall be minded to have & take at such
evaluation & appraisment as herein after mentioned the crops live & dead
stock dressings & implements of husbandry which shall at the time of my
decease be upon about or belonging or be used in the cultivation &
management of the several farms & lands which shall then be in my occupation
then all the said crops live & dead stock dressings & implements of
husbandry shall as soon as conveniently may be after my decease be valued &
appraised by two different persons one of them to be known by my exors
herein after named & the other of them by my said nephew John Weaire
& if these two persons shall not agree in making the said valuation &
appraisment then that the difference between them shall be determined by
such third indifferent person as those two shall choose for that purpose
which said third person’s determination shall be final & conclusive and that
upon such valuation and appraisment as aforesaid having been made & upon my
said nephew John Weaire paying to my exors the amount of
the same valuation & appraisment my exors shall deliver unto my said nephew
John Weaire all the said crops live & dead stock &
implements of husbandry which shall have been so valued & appraised as
aforesaid & shall permit him to have & enjoy the same as his own proper
goods & chattels provided nevertheless & it is my will & meaning and I do
hereby direct that no valuation of appraisment whatsoever shall be made of
my term estate or interest in the several leasehold & other messuages farms
& lands herein before by me given & bequeathed unto my said nephew
John Weaire as aforesaid or any of them. Also I give & bequeath
unto my friend John Radley of Bletchingly aforesaid
carpenter the sum of fifty pounds of lawful money to be paid unto him within
twelve calendar months next after my decease by my exors herein after named.
Also I give & bequeath unto my friends George Peters of
Nutfield in the County of Surry aforesaid Gentleman & Thomas Avery
of Bletchingly aforesaid yeoman who are herein after by me appointed
executors of this my will the sum of fifty pounds apiece for their care &
trouble in the execution of this my Will. And all the rest residue &
remainder of my personal estate whatsoever &wheresoever & of what nature or
kind soever I do hereby give & bequeath in the parts & proportions herein
after mentioned unto the several persons herein after named that is to say
one full equal twenty third part thereof (the whole into twenty three equal
parts to be divided) unto my said nephew Michael Field (son
of my said late brother James Field) one other like twenty
third part thereof unto my said niece Ann Bryant one other
like twenty third part thereof unto my said niece Mary Lewry
one other like twenty third part thereof unto my said niece
Elizabeth Smith one other like twenty third part thereof unto my
said nephew Joseph Field (son of my said brother
John Field) one other like twenty third part thereof unto my said
nephew Churchman Field (son of my said brother John
Field) one other like twenty third part thereof unto my said niece
Elizabeth Field (daughter of my said brother John
Field) one other like twenty third part thereof unto my said nephew
Joseph Potter one other like twenty third part thereof unto
my said nephew William Potter one other like twenty third
part thereof unto my said niece Ann Hubble one other like

thereof unto all the children of my said late niece Martha Myrth
the same part to be equally divided amongst them share & share alike one
other like twenty third part thereof unto my said great nephew James
Sanderson one other like twenty third part thereof unto my said
great niece Mary Bannister and the other and remaining
twenty third part thereof unto all the children of my other great niece
Catherine Bilcliffe the same part to be divided amongst
them share & share alike and it is my will & meaning and I do hereby direct
that the same several parts & proportions of the said residue of my personal
estate shall be respectively paid unto the said several persons to whom the
same are herein before by me given & bequeathed as aforesaid at the several
& respective times when the several legacies of Sterling & lawful money
herein before by me given and bequeathed unto the same several persons
herein before by me directed to be paid respectively. And it is my will &
meaning and I do hereby direct that my brother John Field
do and shall when he shall be thereunto requested by the several persons to
whom my real estate is herein before by me given & devised as aforesaid or
any of them at the costs & charges of such of the said persons as shall
request the same execute & deliver unto such persons as shall require the
same one or more good & effectual release or releases in the same of all the
estate right title & interest claim & demand whatsoever of him my said
brother John Field of in & to all my real estate or any
parts or part thereof (save & except the several annuities or yearly rents
charge of thirty pounds five pounds & five pounds herein before by me given
&
devised unto him my said brother John Field & his assigns
during his life as aforesaid. And in case my said brother John Field
shall refuse to execute & deliver such release or releases as aforesaid then
it is my will and meaning and I do hereby direct that the said several
devises or yearly rents charge unto my said brother John Field
& his assigns as aforesaid & the bequest herein before contained of the said
legacy or sum of fifty pounds unto my said brother John Field
as aforesaid shall lapse & be void to all intents & purposes
whatsoever & that he my said brother John Field shall not
receive & shall not be entitled to receive any benefit under this my Will.
And I do hereby nominate constitute & appoint the said George Peters
& Thomas Avery joint executors of this my last Will &
testament provided always & it is my will & meaning and I do hereby direct
that it shall & may be lawful to & for my said exors and the survivor of
them & the exors & admors of such survivor to deduct & retain to & for
themselves & himself from & out of the monies which shall come into their or
his hands under & by virtue of this my Will all & every such lawful &
reasonable costs charges expences & disbursements as they or any of them
shall or may pay bear sustain expend or be put unto in or about the
execution of this my Will provided also & it is my will & meaning and I do
hereby direct that they my exors or the survivor of them or the exors or
admors of such survivor or any or either of them shall not be charged or
chargeable with or accountable for the acts neglects receipts or defaults of
the others or other of them nor with or for any more monies that the person
or persons so chargeable or accountable shall respectively actually receive
nor with or for any loss or losses which shall or may happen in the
execution of this my Will other than such as shall be occasioned by their or
any or either of their voluntary or wilful neglects or defaults but each of
them shall be charged & chargeable with & accountable for his own acts
receipts neglects or defaults only and I do hereby revoke all former & other
Wills by me at any time hereto fore made & do declare this only to be my
last Will & Testament. In witness whereof I the said Churchman Field
the testator have to this my last Will & Testament contained in twenty one
sheets of paper set my hand & seal that is to say to the first twenty sheets
thereof my hand & to this twenty first & last sheet my hand & seal the
seventh day of February in the year of our Lord one thousand eight hundred &
