In the Name of God
Amen I Thomas Edsaw of ffittelworth in the County of Sussex
Gentleman Do make and declare this to be my last Will and Testament in
manner and form following that is to say ffirst I give devise and bequeath
unto my ffriends John King the Younger of Loxwood and
Robert ffoard of ffrog ffarm in Idworth All and every my
Messuages ffarms Lands Tenements Hereditaments and Premises with the
Appurtenances in the several Parishes of ffittleworth Egdean Watesbury
Cowpham Sulborough and West Grinsted in the County of Sussex or elsewhere in
the Kingdom of Great Britain And also all and singular my Goods Chattels and
Personal Estate whatsoever and wheresoever of what nature or kind soever it
may be To hold unto the said John King and Robert
ffoard and the Survivor of them and his Heirs Executors and Admors
In Trust nevertheless to and for the uses intents and purposes following
that is to say In the first Place to pay and discharge all my just debts
ffuneral Expences and the charges of proving this my Will and After Payment
thereof to Pay and Apply the Rents of my Real Estate and the Interest of my
Personal Estate then remaining unto And to the use of my Honored Mother
Sarah Edsaw for and during the term of her natural life And
from and after her decease to pay out of the Rents of my Real Estate (then
remaining) and the Interest of my Personal Estate (if any) unto my Brother
William Edsaw One Annuity or Yearly Sum of One hundred
Pounds of lawful Money of Great Britain to be paid to him for and during the
term of his natural life by half Yearly Payments on Christmas day and
Midsummer Day in cash and every Year the first payment thereof to begin and
be made on such of the said Days as shall first and next happen after the
decease of my said Mother And as to the Remainder of the said Rents and
Dividends or Interest Money In Trust to Pay and apply the same unto and to
the use of my Sister Sarah Tripp Wife of Mr James
Upton Tripp for her separate benefit independent of the said
James Upton Tripp or any future Husband which she may
hereafter intermarry with and do direct her receipt from time to time to be
a sufficient discharge to my Trustees Paying the same And after the death of
my said Brother William Edsaw I give the said Annuity of
One hundred pounds unto my said Sister Sarah Tripp for her
sole use independent of her present or any future husband and do direct her
receipt to be a discharge for the same And I do also expressly order and
direct that no Part of the Money I have given to my said Sister
Sarah Tripp shall be subject in Any Degree to the Debts Controul of
her present or any future taken husband And from and after the decease of my
said Sister Sarah Tripp In Trust to convey my Real Estate
and Assign transfer or Pay my Paternal Estate (Subject to the said Annuity
to my Brother William in case he shall be then living) unto
all and every the Children of my said Sister Sarah Tripp
already born or hereafter to be born as well Daughters as Sons equally
between them to take as to the Real estate as Tenants in Common and not as
Joint Tenants And I do give devise and bequeath the same to the Children of
my said Sister Sarah Tripp accordingly And I do hereby make
nominate and appoint the said John King the Younger And
Robert ffoard Executors In Trust of this to be my last Will
and Testament and do declare it to be my Will and meaning that they shall
not be accountable the One of them for the Other but each for his own Acts
only nor for any loss which shall or may happen to my Estate or Effects And
that it shall and may be lawful to and for them and each of them
respectively to retain to and reimburse themselves and himself all and
whatsoever Sum or Sums of Money which he or they shall or may expend
disburse or lay out in or about the Execution of this my Will and reasonably
for their time and trouble In Witness whereof I the said Thomas
Edsaw the Testator have to this my last Will and Testament set my
hand and Seal this fourteenth day of ffebruary in the Year of our Lord one
